The High Court has nullified the election of Luyimbazi Elias Nalukoola as the MP for Kawempe Division North, Kampala.
Justice Bernard Namanya, declared the seat vacant and ordered the Electoral Commission to organize a fresh election for the constituency.
The judgement follows a controversial Kawempe North by-election and a legal battle between Opposition National Unity Platform (NUP) Elias Luyimbazi Nalukoola and National Resistance Movement (NRM) candidate Faridah Nambi, with the latter claiming the process was rife with bribery and intimidation.
“This court has reached a decision to set aside the election of Luyimbazi Elias Nalukoola as Member of Parliament for Kawempe North Division constituency for two main reasons:
1. 16,640 voters in the constituency including Nambi Faridah Kigongo were denied the right to vote (disenfranchised) which affected the result of the election in a substantial manner.
2. Luyimbazi Elias Nalukoola personally campaigned on election day at Mbogo Primary school playground (KAT-MAJ) and Kazo Angola (KAL-KZ) polling stations which is an offense under section 100(1)(a) and (3) of Parliamentary Elections Act (Cap 117).” The ruling concludes.
The orders also direct that each party bears it’s costs in the suit.
